Space Law, Outer Space Law relevance

Just in case if somebody is interested in Space Law basics.
Outer Space Treaty
United Nations has a special body for that purpose
office for Outer Space Affairs

The next episode somehow will be related with space law. I’m pretty sure somebody will ask the same or similar questions.
So let’s suppose that the Chinese (or any other country) are starting the moon’s or asteroid’s mining. As far as I know according to the Outer Space Treaty and Moon treaty:

…“Outer space, including the Moon and other celestial bodies, is not subject to national appropriation by claim of sovereignty, by means of use or occupation, or by any other means.”…

What legal regulation exists for that issue ? if I am right, we can not legitimately mining the moon or asteroids yet. This is not a problem today but in a few decades it will be for sure.
Any thoughts ?
